A couple from Pennsylvania is filing a product liability case against Pfizer; this is due to their drug called Zoloft that the mother took during her pregnancy that caused a child she bore four years ago to have abnormalities.
Downingtown, Pa. residents Amanda and Barry Ebright, through their legal counsel, are filing a case against the drug company at the U.S. District Court in Philadelphia.
The couple is filing a lawsuit against Pfizer Inc. and its subsidiary, Greenstone LLC. , on behalf of their minor child, who was born abnormal due to the ingestion of the company’s antidepressant drug – Zoloft while the mother was pregnant. The girl is now four years old.
Pfizer Inc. and its subsidiary, Greenstone LLC., is defendant of the lawsuit.
According to the mother, Amanda Ebright was prescribed and ingested Zoloft during the term of her pregnancy. This drug is both dangerous and defective for the health of a person, both unfit and unsuitable to be out in the market and sold commercially and does not include any warning of a possible danger resulting from its use.
The main allegation given against the drug was that it is the reason why the child of the couple was born with a birth defect known as a ventricular septal defect.
The child has been given multiple treatments which includes – screening, testing and medication.
The need for a surgery in the near future is also featured in the case.
Before Amanda Ebright was prescribed Zoloft during pregnancy, Pfizer should have included some warnings the taking the medicine during pregnancy posed some kind of dangers to the developing fetus, according to the couple, this was no mention of any risk.
The drug company seems unconcerned in warning imbibers, like Ebright of the danger associated with pregnancy; instead, they hid, prevented and avoid mentioning the danger. .
Every drug company has all the data about their medicine and just didn’t bother. They may have known that Zoloft caused congenital birth defects and are aware that physicians prescribing the drugs and consumers taking the drugs rely on the effectiveness of their product.
Several counts of product liability, negligence, negligent design, negligent misrepresentation, fraud and fraudulent concealment, and breach of implied and express warranties are enumerated in the law suit.
The complainants are seeking damages affecting their economic loss, medical expenses, loss of earnings, mental and emotional distress, costs and litigation expenses, attorney’s fees, pre-and-post-judgment interest and treble and/or punitive damages.
